Section 23 Civil servants and employees

(1) Without prejudice to the right to employ workers, BaFin is granted the right to have civil servants.


(2) 1The officials of the Federal Agency are federal officials. 2 The highest service authority and the highest service superior is the president; Section 2 (2) of the Post Social Insurance Organization Act remains unaffected. The highest federal authority responsible for supervision within the meaning of Section 144 of the Federal Civil Servants Act is the Federal Ministry of Finance. 4The Federal Ministry of Finance, after hearing or on the proposal of the President, determines which post holders below the President exercise the powers of a superior for the civil servants employed by the company social institutions. 5The provision is to be published in the Federal Law Gazette.


(3) 1The Federal President appoints and dismisses the civil servants of the federal salary regulation B of the Federal Agency. 2The President appoints and dismisses the civil servants of the federal pay regulations A.


(4) At the Federal Agency, the upper limits for transport offices permitted under Section 26 (1) of the Federal Salary Act may be exceeded, insofar as this is necessary because of the requirements associated with the functions.


(5) 1If a civil servant is entitled to a position allowance in accordance with the preliminary remark number 7 to the salary regulations A and B of the Federal Salary Act, this will continue to be granted for the duration of this employment. 2 Crediting rules apply.
